"We're at the top of the band" - what it means and what to say
The situation. You countered. The recruiter comes back: “We’d love to, but we’re already at the top of the band for this level.” It sounds like a locked door: official, structural, final. Most candidates hear it and stop negotiating. That’s the expensive mistake.
What’s actually happening. Salary bands are real: most tech companies define a min–max range per level, and recruiters genuinely can’t exceed it on base. But “top of band” means one of three things: sometimes it’s literally true; sometimes it’s true enough (a little room, guarded hard); and sometimes it’s a standard line for managing expectations. Here’s why you don’t need to guess which: in all three cases the next move is identical. Bands cap the base. Equity and signing bonuses usually live in different budgets, approved through different doors. And there’s a deeper version worth knowing: if the whole band feels wrong, the real issue may be the level you were scoped at, a different conversation entirely.
What to say. One sentence keeps the negotiation alive:
“I understand, and I appreciate you explaining that. If there isn’t room to move the base further, is there any flexibility in other parts of the package, like equity or a signing bonus?”
And if you’re leaving unvested compensation behind, the specific version:
“One thing that could really help bridge the gap is a signing bonus. If the base has to stay at [base], would you be open to adding a signing bonus of around [amount] to bring the first-year compensation closer to what I had in mind?”
The mistakes that cost the most: hearing “band” and ending the conversation · arguing whether the band is real (irrelevant: the pivot works either way) · asking vaguely (“is there anything else you can do?”) instead of naming the levers · never asking what level the offer was scoped at.
